Auto Accidents

Aggressive and Talented Representation for Auto Accidents

Injuries and deaths from auto accidents make up 90% of our cases at Lastovich Law Office. Decades ago, Minnesota became a “no fault” automobile accident state which means that in most cases your own automobile insurance carrier pays your medical bills up to $20,000 and wage loss at the rate of up to $500 per week, to a maximum of $20,000.

If you have sustained a significant injury, you can also pursue additional compensation against the driver who caused the accident and his or her insurance company.

How "No Fault" Auto Accidents Are Handled

The term “no fault” can be a bit misleading. In order to bring a claim above and beyond medical wage loss benefits, you must be able to show that the other driver was at least 50% at fault or more under Minnesota’s comparative fault laws. If you are more than 50% at fault, you are barred from making a claim.

Furthermore, the amount of compensation that you receive can be reduced by the percentage that you are at fault. For example, if you are entitled to $100,000 in damages but you are determined to have been 20% at fault, you would lose 20% of the $100,000 for a net amount of $80,000. This is one of the reasons that early investigation by a law firm may be critically important to the ultimate outcome of the case.

How Auto Insurance Comes Into Play

Sometimes the at-fault party to an auto accident does not have enough automobile insurance. If this is the case, your own under insured motorist benefits through your own policy will provide additional benefits. If the defendant carried no insurance (which is fairly common these days), you would turn to your own uninsured motorist benefits under your policy.

In auto accident cases, Lastovich Law Office represents most injured parties on a 1/3 contingency fee basis. This means that you do not have to pay any fees upfront and you pay only at the end, based on 1/3 of the settlement. One of the most confusing times for a person who has suffered an accident is during the initial onslaught of trying to complete all of the paperwork and handle property damage when one is struggling with injuries. This is something we handle for our clients every day to relieve the stress of paperwork and the financial burden.
